3. TERMS & CONDITIONS 

Purpose: Set clear expectations around services, payments, and image usage.

3.1 General Terms

  • Agreement to terms by using the site

  • agree to all privacy polices & usage terms listed above

3.2 Booking & Services

  • Booking process throguh website & invoices

  • Contract requirement in bookings

  • Session details in bookings:

    • Location

    • Time

    • Deliverables

3.3 Payment Policy

  • Pricing is structured and laid out on the booking page 

  • Deposit requirements before booking

  • Payment methods accepted: credit, debit, Apple Pay

  • Payment deadlines: cash, venmo & pay pal 

  • Late fees apply if 30 minutes late to shoot

3.4 Cancellation & Refunds

  • Cancellation window: Please let us know if something comes up during your scheduled time. We would love to be able to reschedule you first, but if needed, a refund can be made so long as you cancel 12 hours before your shoot!

  • Refund policy:

    • If canceled 12 hours before the shoot full refund

    • If canceled within 12 hours of the shoot (for non-medical or family emergency) than a refund of half the deposit

    • Rescheduling terms

  • Photographer cancellation clause:

  • If I need to cancel 12 hours before a shoot, than 20% of your original deposit will be refunded 

  • If I need to cancel 12 hours before a shoot and I am unable to reschedule in a sufficient amount of time (within 2 weeks of the original shoot date), than 25% of your original deposit will be refunded 

  • If I cancel within 12 hours of the shoot and we can reschedule within 2 weeks, than 30% of your original deposit will be refunded 

  • If I cancel within 12 hours of the shoot and I am unable to reschedule in a sufficient amount of time (within 2 weeks of the original shoot date), than 50% of your original deposit will be refunded 

  • If I need to cancel 12 hours before a shoot and we are unable to reschedual a full refund will be issued back to your the client

3.5 Image Delivery

  • Delivery timeline: I try my hardest to be as transparent as possible. I am a student, business owner & pilates instructor! Depending on the shoot, length, and style, please give me 2-6 weeks to send photographs back to you!

  • Format: I only send back digital galleries. If you would like prints i have contacts, but I cannot complete that for you!

  • Number of images: it depends on the length of the shoot and the number of participants!

  • Backup/storage duration: I will only keep the albums sent on hand for a month, as the client you are responsible for downloading and keeping hold of your photos

3.6 Image Usage & Licensing

Ownership

  • Photographer retains full copyright

License Granted to Client

  • Personal use license includes:

    • Printing

    • Sharing on social media (with credit if required)

Restrictions

  • No resale

  • No editing/alteration without permission

  • No commercial use unless licensed

  • NO AI TRAINING OR DATA COLLECTIONS

Commercial Licensing

  • Separate pricing and agreements required

3.8 Creative Control

  • Photographer retains artistic discretion

  • Editing style is consistent with the portfolio

3.9 Liability Limitation

  • Not responsible for:

    • Uncontrollable events (weather, emergencies)

    • Loss of images due to technical failure (with reasonable safeguards like loss of SD card & improper communication for the gallery)

3.10 Website Use Restrictions

  • No scraping, copying, or misuse of content

  • No unauthorized downloads

3.11 Governing Law

  • Jurisdiction: State of North Carolina, USA

3.12 Changes to Terms

  • Right to update terms at any time
